Terms of Service

1. Acceptance of Terms

By accessing or using MegaConvert.io (“the Service,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, whether through the website, API, or any other means. By creating an account, uploading a file, or making a payment, you confirm that you have read, understood, and accepted these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

MegaConvert.io is an online file conversion platform that allows users to convert files between various formats. The Service includes:

  • File Conversion — Convert documents, images, videos, audio files, ebooks, and other formats.
  • File Tools — Compress, merge, split, and manipulate files using our built-in tools.
  • REST API — Programmatic access to conversion and tool capabilities for eligible subscribers.

We continuously improve and expand the Service. Features may be added, modified, or removed at our discretion.

3. User Accounts

3.1 Registration

You may use certain features of the Service without creating an account. However, to access paid features, view conversion history, or use the API, you must register for an account by providing a valid email address and password.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at office@megaconvert.io if you suspect any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or if your account has been inactive for more than 12 months. You may delete your account at any time through your account settings.

4. Free vs Paid Services

4.1 Free Tier

Unregistered and free users may perform up to 3 conversions per day with a maximum file size of 25 MB per file. Free conversions are subject to standard processing queues and files are automatically deleted 1 hour after conversion.

4.2 Pay-per-Use

For files exceeding free tier limits or for additional conversions, users may purchase individual conversions on a pay-per-use basis. Pricing ranges from $2 to $15 based on file size and conversion complexity.

4.3 Subscriptions

We offer subscription plans with enhanced benefits:

  • 6-Month Plan — $49 (billed once)
  • 12-Month Plan — $79 (billed once, includes API access)

Subscribers enjoy unlimited conversions, priority processing, larger file size limits, and extended file retention (up to 7 days). Subscriptions auto-renew at the end of each billing period unless cancelled.

5. Acceptable Use

You agree not to use the Service to:

  • Upload, convert, or distribute files that contain illegal content under German, EU, or your local law.
  • Upload files containing malware, viruses, trojans, or any other malicious code.
  • Infringe on any third party’s intellectual property rights, including copyrights, trademarks, or trade secrets.
  • Upload child sexual abuse material (CSAM) or any content that exploits minors.
  • Attempt to bypass usage limits, rate limits, or security measures through automated means.
  • Use the Service to harass, abuse, or harm others.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Resell or redistribute the Service without our written consent.

We reserve the right to remove any content and suspend or terminate accounts that violate these terms without prior notice.

6. File Upload Policy

6.1 Permitted Files

You may upload files in any format supported by our conversion tools. A full list of supported formats is available on our website and via the API.

6.2 File Size Limits

Free tier users are limited to files of 25 MB or less. Pay-per-use and subscription users have higher limits as specified on our pricing page.

6.3 Virus Scanning

All uploaded files are scanned for malware and viruses. Files that fail scanning will be rejected and deleted immediately. We reserve the right to refuse any upload that we deem harmful or suspicious.

6.4 Automatic Deletion

Files are automatically and permanently deleted according to the following schedule:

  • Free tier: 1 hour after conversion
  • Pay-per-use: 24 hours after conversion
  • Subscribers: Up to 7 days

We do not provide long-term file storage. You are responsible for downloading your converted files before they are deleted.

7. Intellectual Property

7.1 Your Files

You retain full ownership of all files you upload to the Service. We do not claim any intellectual property rights over your content. We do not access, view, analyze, or share the contents of your files for any purpose other than performing the requested conversion or tool operation.

7.2 Our Service

The Service, including its design, code, trademarks, logos, and all related content, is owned by MegaConvert.io and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Payment Terms

8.1 Pricing

All prices are displayed in US Dollars (USD) and include applicable taxes where required. We reserve the right to change pricing at any time, but existing subscriptions will be honored at their purchased rate until the end of the current billing period.

8.2 Payment Methods

We accept payments via PayPal and Stripe (coming soon). All payment processing is handled securely by these third-party payment providers. We do not store your full credit card or payment account details on our servers.

8.3 Subscription Billing

Subscriptions are billed at the start of each billing period (6 months or 12 months). Subscriptions automatically renew at the end of each period unless you cancel before the renewal date. You can cancel your subscription at any time through your account dashboard.

8.4 Failed Payments

If a payment fails, we may attempt to process it again. If payment cannot be collected after reasonable attempts, your subscription may be downgraded to the free tier.

9. Refunds

Our refund policy is detailed on our Refund Policy page. In summary:

  • Pay-per-use purchases are eligible for a full refund if the conversion fails or produces corrupted output.
  • New subscriptions include a 14-day money-back guarantee.
  • All refund requests must be submitted within 24 hours of purchase (pay-per-use) or 14 days (subscriptions).

10. Service Availability

10.1 Free Tier

The free tier is provided on a “best effort” basis. We do not guarantee uptime, availability, or processing speed for free users.

10.2 Paid Services

For paying customers, we target 99.9% uptime on an annual basis. This does not constitute a Service Level Agreement (SLA) and no credits or compensation are offered for downtime.

10.3 Maintenance

We may perform scheduled or emergency maintenance that temporarily affects Service availability. Where possible, we will provide advance notice of planned maintenance.

11. API Terms

11.1 Eligibility

API access is available exclusively to users with an active 12-month subscription. API keys are issued through the account dashboard.

11.2 Rate Limits

API usage is subject to rate limits as documented in our API Documentation. Exceeding rate limits may result in temporary throttling or suspension of API access.

11.3 Fair Use

API access is intended for reasonable, legitimate use. Automated mass conversions that place excessive load on our infrastructure may be throttled or restricted. We reserve the right to define and enforce fair use limits.

11.4 API Key Security

You are responsible for keeping your API keys confidential. Do not embed API keys in client-side code or public repositories. Compromised keys should be revoked immediately through your dashboard.

12. Data Processing

We process personal data in accordance with our Privacy Policy and in compliance with the EU General Data Protection Regulation (GDPR). By using the Service, you acknowledge that you have read and understood our Privacy Policy.

Files uploaded for conversion are processed solely for the purpose of performing the requested operation. We do not use your files for training, analytics, advertising, or any other secondary purpose.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that conversion results will be accurate or complete.
  • In no event shall MegaConvert.io, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
  • Our total aggregate liability for any claims arising from your use of the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless MegaConvert.io and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Your use of the Service or any activity under your account.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any content or files you upload to the Service.

15. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the “Last updated” date at the top of this page and, for registered users, by sending an email notification.

Your continued use of the Service after changes are published constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and close your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany and, where applicable, the laws of the European Union, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Germany. If you are a consumer residing in the EU, you retain any mandatory consumer protection rights afforded by the laws of your country of residence.

Nothing in these Terms shall limit your rights under mandatory consumer protection legislation in your jurisdiction.
